Terms of Use

This is a contract between you and GeNext Software™. In using this site, you agree to the following terms:

If you submit personal information, you warrant and represent that you are thirteen years of age or older. Under United States law, GeNext Software™ cannot accept personal information from small children.

This information comes with absolutely no warranty. You may not hold GeNext Software™ or any operator of GeNext Software™ liable for any damages, including without limitation special, incidental, or consequential damages.

Before considering bringing legal action against GeNext Software™ or any operator of GeNext Software™ on any grounds including without limitation governmented-granted monopolies such as copyright, patent, or trademark law, you must consider whether you have a valid case. You agree to the common law principle of "jury nullification," which specifies that a jury may throw out a statute that it finds unjust. Before you sue us, remember that barratry is a crime in all 50 states.

As unsolicited bulk email is illegal in the United States, you agree not to spam GeNext Software™. Specifically:

1. You will not send any unsolicited bulk email ("spam") to any email address mentioned in the document or related information as defined above, and you will not pass on any email address extracted from the document or related information to entities that might violate these terms.
2. Furthermore, you agree that if you violate these terms:
   1. You will pay a $1,000.00 fee for reading and responding appropriately to every recipient of your unsolicited message. This fee automatically increases by $20 per started kilobyte contained in your unsolicited message to reimburse the recipient for network traffic cost.
   2. Concealing your identity (e.g. through using a fake email address) increases the fee by $1,000.00 to compensate for the effort to track down the sender.
   3. If you made any money by violating these terms (including but not limited to the the action of selling a list of email addresses containing any address obtained in violation of this contract), the fee is increased by $10,000.00 or ten (10) times the amount of money you made, whichever is greater.
   4. You will carry all further consequences that may emerge from your violation of the terms of service, including but not limited to any possible lawsuit from the recipient's internet service provider.
   5. In the event that any suit or action is instituted to enforce any provision in this contract, the recipient of the unsolicited email shall be entitled to all costs and expenses of maintaining such suit or action, including but not limited to reasonable attorney's fees.
   6. The abuse of the recipient's mail server constitutes gaining unauthorized access to computers as well as theft of service, and may be brought to the attention of any related authorities regardless of any fee you paid.

The look of the GeNext Software™ website is a trademark of GeNext Software™.

These terms have been in effect since February of 2004.

Privacy Policy

1. We do not sell, share, or rent personal information about our users obtained from their use of our site or their correspondence with our staff. This includes but is not limited to information provided on feedback forms and any other way of contact we choose to give the user.
2. GeNext Software™ maintains usage log files which may collect IP addresses from users for uses such as determining what countries our visitors are from and what internet service providers they use. There is no personal information collected during this process. GeNext Software™ may be able to determine which search engine or other third-party site a user came from if a user found our site through a link.
3. Reproduction in whole or in part in any form or medium without express written permission of the copyright holder, except for clearly fair use as defined by 17 USC 107, is prohibited.
4. Many pages on GeNext Software™ contain links to other websites. These third-party websites may have privacy policies different from our own. Users should check with each site for their privacy policy.
